Obama Violates the Constitution AGAIN with planned action
By BEN FELLER, Associated Press Writer Ben Feller
WASHINGTON – Fed up with waiting, President Barack Obama announced Saturday he would bypass a vacationing Senate and name 15 people to key administration jobs, wielding for the first time the blunt political tool known as the ‘recess appointment’.
The move immediately deepened the divide between the Democratic president and Republicans in the Senate following a long, bruising fight over health care. Obama revealed his decision by blistering Republicans, accusing them of holding up nominees for months solely to try to score a political advantage on him.
First off; Let us examine what a “Recess Appointment” is (from Wikipedia):
A recess appointment occurs when the President of the United States fills a vacant federal position, of a sufficiently senior level that the nomination must be confirmed by the Senate, while the Senate is in recess. To be confirmed, the appointment must be approved by the Senate by the end of the next session of Congress (which in current practice means by roughly the end of the next calendar year), or the position becomes vacant again. Recess appointments are authorized by Article II, Section 2 of the U.S. Constitution: “The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.”
So, ole “Slimy Barry” (we’ve already had a ‘Slick Willie’) is going to use this trick to get his way. The Constitution says in Article II, Section 2 that the purpose of this measure is to fulfill a Vacancy that happens DURING a recess. These positions were not vacated during a recess, they have been vacant because they require Senate approval. And even with a Supermajority in the Senate (until Scott Brown took office) he couldn’t get his Radical / Communist / Socialist / Terrorist choices passed.
Now he’s telling the American people that it is “Partisan Politics” standing in the way of him filling these key positions. “I simply cannot allow partisan politics to stand in the way of the basic functioning of government,” Obama said in a statement.
This Patriot says “Go Ahead Barack”, and then on January 4, 2011, with a very small number of Democrats in the House of Representatives, they can bring charges of Impeachment against him for violating the U.S. Constitution.
